GPS Tracker & Location Tracker User Agreement

1. Acceptance of Terms

1.1 Agreement Structure

This User Agreement ("this Agreement") is entered into by and between NAICOO PTE. LTD. ("the Company" or "we") and you ("the User"). This Agreement serves as the foundation for your use of the "GPS Tracker & Location Tracker" mobile application ("the App") and its related services.

1.2 Acceptance

By registering, accessing, or using the App, you acknowledge that you have read, understood, and accepted all terms and provisions of this Agreement, as well as the accompanying Privacy Policy. If you do not agree to any term of this Agreement, you must immediately cease using the App.

2. Service Content and Usage Authorization

2.1 Nature of Service

The core service of the App is to provide security location features such as real-time location tracking and geo-fence alerts. This service can only be implemented based on the User's explicit, voluntary authorization and binding relationship.

2.2 Usage Authorization

The Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on your personal mobile device. This license is solely for the purpose of location sharing and secure tracking with friends or family members whom you have expressly authorized and bound within the App.

3. User Commitments and Code of Conduct

3.1 Accurate Information

You warrant that the registration information you provide (including, but not limited to, your mobile phone number) is true, accurate, and complete.

3.2 Safe Use

You commit to using the App solely for lawful, good-faith security purposes. You must not use the App to track or monitor unauthorized individuals, nor for harassment, privacy infringement, or any other illegal purpose.

3.3 Responsibility for Authorization

You understand and agree that enabling real-time location sharing requires the explicit and continuous consent of both you and the party being tracked. You bear full responsibility for any legal consequences or disputes arising from the misuse of the App's location tracking features.

3.4 Usage Restrictions

You shall not engage in the following activities:

• Accessing or interfering with the Company's systems or data without authorization.
• Using the App for commercial purposes or reselling the service.
• Spreading any content that is unlawful, harmful, defamatory, intimidating, or infringes upon intellectual property rights.

4. Processing of Real-Time Location Data

4.1 Data Collection and Use

To provide the core location service, the App must collect and process your precise real-time geographic location data. For details on how we collect, use, share, and protect this sensitive information, please refer to the Privacy Policy.

4.2 Reference to Privacy Policy

Any terms regarding the processing of personal information not defined in this User Agreement shall be governed by the provisions of the Privacy Policy. By accepting this Agreement, you also accept the entirety of the Privacy Policy.

4.3 Informed Consent

You acknowledge that, once you bind with a friend, your real-time location data will be shared with that friend until either you or the friend actively unbinds the relationship or revokes device permissions.

5. Restrictions on Minor Use

5.1 Age Restriction

The App is not directed at minors under the age of 16. If you are under 16, please do not register for or use the App.

5.2 Parental Consent

If you are below the age of majority in your jurisdiction (but are 16 years of age or older), you must use the App under the supervision and with the explicit consent of your legal guardian (parent or other legal guardian). The guardian shall be responsible for the minor's use of the App.

6. Intellectual Property

All intellectual property rights, including but not limited to content, technology, software, trademarks, and copyrights of the App, are owned by the Company or its licensors. You may not copy, modify, distribute, or use them in any way without the Company's prior written permission.

7. Disclaimer and Limitation of Liability

7.1 Services Provided "As Is"

The App and its services are provided on an "as is" and "as available" basis. The Company makes no express or implied warranties regarding the accuracy, reliability, timeliness, or completeness of the services.

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, or punitive damages arising from your use of or inability to use the App.

8. Modification and Termination of the Agreement

8.1 Agreement Modification

The Company reserves the right to modify this Agreement at any time. The modified Agreement will be published within the App and will become effective upon its publication. If the modification constitutes a material change, we will notify you through a prominent notice.

8.2 Termination

You may terminate this Agreement at any time by permanently deleting the App and cancelling your account. The Company reserves the right to suspend or terminate the services to you at any time if you violate the terms of this Agreement.

9. Governing Law and Dispute Resolution

The conclusion, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of [Please fill in the governing law, e.g., the Republic of Singapore].
